1. Introduction & Acceptance
These Terms and Conditions ("Terms") govern your access to and use of the Besty Food online platform (the "Platform") — including the website at bestyfood.com and any associated applications — operated by JASFA Freedom Traders Pvt Ltd (the "Company", "Besty Food", "we", "us", "our"). Besty Food is part of the Profit Traders ecosystem.
By accessing the Platform, browsing Products, placing an Order, or creating an account, you agree to be bound by these Terms and our Privacy Policy. If you do not agree with any part of these Terms, please do not access or use the Platform.
2. Definitions
- "Platform" — the Besty Food website, applications and services through which Products are listed and ordered.
- "Merchant" — a participating grocery store, food merchant or seller whose Products are listed on the Platform.
- "Products" — groceries, fresh produce, everyday essentials and prepared food items listed by Merchants.
- "Order" — a request placed by you through the Platform for the purchase of Products from a Merchant.
- "Delivery Partner" — a delivery service engaged to fulfil delivery of an Order, where applicable.
- "You" / "User" — any person who accesses or uses the Platform.
3. Nature of the Platform
Besty Food operates as an online marketplace and intermediary that connects Users with participating Merchants. Product listings, descriptions and prices are provided by or on behalf of Merchants.
The contract of sale for Products is concluded between you and the Merchant from whom you purchase. The Merchant is responsible for the Products supplied, including their quality, quantity, packaging and labelling, to the extent provided under applicable law. Besty Food facilitates listing, ordering, payment collection and delivery coordination, and assists in good faith with the resolution of disputes between Users and Merchants.
Where required under the Consumer Protection (E-Commerce) Rules, 2020, relevant details relating to Merchants (including their legal name and principal place of business) are displayed on the Platform or made available on request.
4. Eligibility & Accounts
You may use the Platform only if you are capable of entering into a legally binding contract under the laws of India. Users who are minors may use the Platform only under the supervision of a parent or legal guardian.
You agree to provide accurate, current and complete information, to keep your account credentials confidential, and to notify us promptly of any unauthorized use of your account. You are responsible for all activity that occurs under your account. We may suspend or terminate accounts that misuse the Platform or breach these Terms.
5. Orders, Pricing & Availability
All prices are displayed in Indian Rupees and are inclusive of applicable taxes unless stated otherwise. Prices and availability of Products are subject to change without notice, and an Order is accepted only upon confirmation communicated through the Platform.
We or the Merchant may refuse or cancel an Order — including after acceptance — in situations such as: the Product being out of stock, a pricing or listing error, your delivery area not being serviceable, failure or suspicion of payment, or suspected fraudulent activity. In such cases, you will be notified and any amount already paid will be refunded in accordance with these Terms.
6. Payments
Payments are processed through the payment options displayed at checkout, using third-party payment gateways and banking partners. Your use of a payment option is also subject to the terms of the applicable provider.
Applicable taxes, delivery charges (where levied) and other fees are shown at checkout. Failed, declined or reversed transactions are handled in accordance with the applicable payment provider's procedures and applicable law.
7. Delivery
Delivery is offered only in areas where the service is available. Delivery times shown on the Platform are good-faith estimates and depend on factors such as Merchant preparation times, Delivery Partner availability, traffic and weather conditions.
Perishable Products should be inspected at the time of delivery; please report any issue promptly (for perishables, we recommend the same day). Risk and title in the Products pass to you upon delivery at the address provided, to you or to a person you authorize to receive the Order.
8. Cancellations, Returns & Refunds
- Before dispatch: you may cancel an Order through the Platform or via the official support channels, and any amount already paid will be refunded.
- After dispatch or delivery: cancellations, returns and replacements are handled in accordance with the applicable Merchant's policy and applicable law.
- Perishables: issues with perishable Products should ideally be reported at delivery, and in any case on the same day as delivery.
- Refunds: approved refunds are processed to the original payment method, subject to the timelines of the payment provider involved.
Nothing in these Terms limits or excludes any statutory rights available to you as a consumer under applicable law, including the Consumer Protection Act, 2019.
9. Acceptable Use
You agree not to use the Platform for any unlawful purpose, to place fraudulent or duplicate Orders, to interfere with or disrupt the Platform, to scrape, copy or reverse-engineer any part of it, or to transmit any malicious code or harmful content. You agree to comply with all applicable laws while using the Platform.
We may block access to the Platform for violations of these Terms and reserve the right to pursue legal remedies where warranted.
10. Intellectual Property
The "Besty Food" name, logo, wordmark, website design, text, graphics and other content on the Platform are owned by the Company or its ecosystem entities and are protected by applicable intellectual property laws.
You are granted a limited, non-exclusive, non-transferable licence to access and use the Platform for personal, non-commercial purposes. Any other use requires our prior written consent.
11. Disclaimers
The Platform is provided on an "as is" and "as available" basis, to the extent permitted by applicable law. Products are supplied by independent Merchants; while Besty Food facilitates reasonable diligence in onboarding, it does not independently verify every listing, and does not warrant the availability, accuracy or completeness of Merchant-supplied information.
Nothing in these Terms excludes or limits any warranty, obligation or liability that cannot be excluded or limited under applicable law. To the extent applicable, the Company relies on the protections available to intermediaries under the Information Technology Act, 2000.
12. Limitation of Liability
To the maximum extent permitted by applicable law, the Company's aggregate liability arising from or relating to any Order or use of the Platform is limited to the value of the relevant Order, and the Company is not liable for any indirect, incidental, special or consequential losses.
Nothing in these Terms limits any liability that cannot be limited under applicable law.
13. Governing Law & Jurisdiction
These Terms are governed by and construed in accordance with the laws of India. Subject to mandatory provisions of applicable law, the courts at Namakkal, Tamil Nadu, India have exclusive jurisdiction over any dispute arising out of or in connection with these Terms or the Platform.
14. Grievance Redressal
Complaints and grievances may be submitted to our Grievance Officer in accordance with the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011, and other applicable law:
Grievances are acknowledged promptly and addressed within the timelines prescribed under applicable law (currently one month under the IT Rules, 2011). Consumer complaints may also be pursued through the remedies available under the Consumer Protection Act, 2019.
15. Changes to These Terms
We may amend these Terms at any time by posting the updated version on this page. Changes take effect upon posting. Your continued use of the Platform after changes are posted constitutes acceptance of the updated Terms.
